Samsung Request for iPhone 4S Ban in France Denied

The request of Samsung to have the iPhone 4S of Apple (NASDAQ:AAPL) banned in France was denied recently by the Tribunal de Grande Instance de Paris. The reports revealed that the preliminary injunction request of Apple against the iPhone 4S was denied after the judge called it disproportionate. Aside from the denial, Samsung was also ordered to pay the legal fees of Apple.

However according to a representative from Samsung, the company will review the grounds for the judgment and will look at its options in an effort to assert the intellectual property rights of the company. The recent denial of the iPhone 4S ban in France comes as Apple also failed to have the devices of Samsung banned in the US. However Apple has also achieved some favorable decisions in other markets including Germany and the Netherlands.

On the other hand, the favorable decision that Samsung hot in Australia where the ban on its Galaxy Tab was overturned recently may soften the denial on the ban of the iPhone 4S in France. Even as Apple has won a number of favorable decisions against the Samsung Galaxy Tab, Samsung appears to have a hard time in winning an injunction against the iPhone 4S. Some observers were also puzzled on the decision of the company in having the iPhone 4S banned in its home country.

According to the Korean manufacturer, the company aims to go up against Apple in the international market without influencing its share of the Korean market. Reports have also indicated that the next market that the company aims to have the iPhone 4S banned is the Italian market. However, observers have indicated that this may be an uphill battle given the lack of success of Samsung in preventing the sale of the iPhone 4S of Apple.

A Samsung representative revealed that the company has been meeting its obligations in the licensing of its patents related to the telecommunications standards. It claimed that Apple has reportedly infringed on the intellectual property of the company with its devices including the iPhone 4S.

Despite the setbacks, Samsung is reportedly outdoing Apple in the retail market as it reportedly sold around 23 million smartphones around the world as compared to the 17 million iPhone sales of Apple. No statements were issued by Apple in connection to the denial of the ban on the iPhone 4S in France.
